IT BEGINS

A few weeks after Judge Character found Christopher Martin guilty on all counts, we filed Marie’s civil lawsuit in the Cuyahoga County Court of Common Pleas in Cleveland, Ohio, effectively beginning the case against Burger King; Harold Stillwater, the businessman who’d owned the franchise prior to assigning it to his own company; and Quick Eats Enterprises, Inc., the company to which Stillwater had transferred his ownership. Several months earlier, Marie had decided that she did want to pursue a case against the restaurant and had given us permission to proceed. By filing the lawsuit, we were finally in a position to discover all of the facts and try to develop the case.

In the previous few months, we had uncovered what we could. I had talked to Christy Washington and Sheila Williams, the two women who had watched the events unfold from a nearby apartment building. At first both women were reluctant to talk to me, but after I told them how grateful Marie was for their help, they opened up. They estimated that the two men had been loitering in the parking lot for about an hour to an hour and a half, roughly from dusk until the shooting at 6:30. After the shooting, both men had run away, although the tall man had returned to retrieve his car a few minutes later. They had also watched Marie as she staggered out of her car and ran into the restaurant. I thought that when the time came for them to testify at trial, they could be compelling eyewitnesses.
